Letters: Texas' actions to defend border aren't 'lawless'

In his letter, “Sending troops to border violates law,” James Taylor posits that Gov. Jeff Landry’s proposal to send Louisiana National Guard troops to Texas violates the supremacy clause of the U.S. Constitution.

The purpose of the plan is to assist Texas in blocking federal agents’ access to the border, where Texas National Guard troops have erected razor wire barriers to immigrants coming into the country. Landry’s proposal could legitimately be challenged under Article I, Section 10 of the U.S. Constitution, which requires Congress’ consent for a state “to enter into any Agreement or Compact with another State, or engage in War, unless actually invaded…”  Neither has Louisiana been “actually invaded,” nor has Congress consented to Louisiana’s making an agreement or compact with Texas.

However, Taylor also says that the actions of Texas are “lawless,” but he is mistaken. Texas Gov. Greg Abbott’s actions are indeed authorized under the Constitution. The illegal entry of foreign nationals into Texas over its objection constitutes an “invasion.” A number of respected military experts have opined that it does.

In that circumstance, Art. I, Sec. 10 authorizes a state to “engage in war.” Article IV, Section 4, states in pertinent part: “The United States . . . shall protect each (State) against invasion . . .” By refusing to “protect (Texas) against Invasion” as required by law, the Biden administration, under Art. IV, Sec. 4, frees Texas to “engage in War” under Art. I, Sec.10.

Texas’ behavior is not “lawless” as characterized by Taylor. Rather, it invokes a remedy explicitly made available to the states by the Constitution and the willful failure of the administration to honor its constitutionally mandated obligation.
